These Terms & Conditions (“Terms”) govern your access to and use of the NeuroAthlete Hub™, the website located at myneuroperformance.com, associated web-based applications, digital programs, assessments, training systems, educational materials, tools, resources, communities, and related services (collectively, the “Services”).
The Services are provided by ALYNED Institute of Human Performance (“ALYNED,” “Company,” “we,” “us,” or “our”) and powered by CogMotion Performance.
By creating an account, purchasing a subscription, clicking “I Agree,” accessing, or using any portion of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
The NeuroAthlete Hub™ is a performance-development platform designed to help athletes, coaches, and members of the athletic community develop the psychological, cognitive, emotional, behavioral, attentional, and performance capabilities required to perform at higher levels.
The Services may include:
The Services are educational and developmental in nature and are intended to help users develop transferable performance skills.
The NeuroAthlete Hub™ provides education, coaching-oriented resources, performance training, and applied performance science.
The Services are not medical care, psychotherapy, psychiatric treatment, clinical psychological treatment, diagnosis, counseling, or emergency mental-health services.
No assessment, score, recommendation, exercise, training protocol, visualization exercise, breathing technique, or other content provided through the NeuroAthlete Hub™ should be interpreted as a medical or psychological diagnosis.
The NeuroAthlete Progress Index™, athlete archetypes, performance assessments, and related tools are designed for performance-development purposes only. If you require medical, psychological, psychiatric, or other licensed professional care, you should consult an appropriately qualified professional.
Human and athletic performance is influenced by numerous variables, including training, skill development, physical preparation, recovery, sleep, nutrition, coaching, environment, experience, motivation, emotional state, competition, injury, and individual circumstances.
Accordingly, ALYNED does not guarantee any particular performance outcome. Use of the NeuroAthlete Hub™ does not guarantee improved athletic performance, team selection, starting position, scholarships, championships, rankings, professional contracts, employment, earnings, college admission, competitive success, or specific psychological or behavioral outcomes.
Performance development requires individual application, practice, consistency, and circumstances beyond the control of ALYNED.
You must have the legal capacity to enter into this Agreement. The NeuroAthlete Hub™ may be used by athletes of different ages. Where a user is under 18, or another age requiring parental or guardian authorization under applicable law, a parent or legal guardian must review and accept the applicable Parent/Guardian Consent and Minor Athlete Terms before the minor may use the Services.
ALYNED reserves the right to restrict or terminate access if required authorization has not been obtained.
If an athlete is under 18, the parent or legal guardian is responsible for:
A minor athlete may not independently agree to contractual provisions where applicable law requires parental or guardian consent. ALYNED may require verification of parental or guardian authorization before providing access to a minor.
Certain features require registration. You agree to provide accurate information, keep it current, maintain the confidentiality of your login credentials, not share your account with unauthorized individuals, notify ALYNED of suspected unauthorized access, and accept responsibility for activity conducted through your account.
One individual subscription is intended for one individual athlete unless ALYNED expressly provides otherwise. Team, academy, school, organizational, or institutional licenses may be subject to separate terms.
NeuroAthlete Hub™ memberships may be offered through monthly subscriptions, annual subscriptions, promotional subscriptions, individual memberships, premium memberships, team memberships, academy memberships, school or institutional memberships, organizational licenses, and other subscription structures offered by ALYNED.
The applicable price, billing frequency, term, and included Services will be disclosed at the time of purchase. By purchasing a subscription, you authorize ALYNED and its authorized payment processor to charge your selected payment method according to the subscription terms presented at checkout.
Unless otherwise stated at checkout, subscriptions automatically renew at the end of each billing period. Monthly subscriptions generally renew monthly; annual subscriptions generally renew annually. Your subscription will continue until canceled in accordance with these Terms. At checkout, ALYNED will disclose the applicable recurring billing terms, including the amount and frequency of recurring charges.
You may cancel your NeuroAthlete Hub™ subscription at any time. ALYNED provides an accessible online cancellation mechanism through the NeuroAthlete Hub™ (Account → Subscription → Manage Subscription → Cancel Subscription) or another clearly identified account-management method.
To prevent the next recurring charge, cancellation should be completed before the next scheduled billing date. Cancellation stops future renewal charges but does not automatically reverse a payment that has already been processed. If payment is processed through PayPal, you may also manage applicable automatic payments through your PayPal account, but this should not be relied upon as a substitute for cancellation through the NeuroAthlete Hub™.
ALYNED maintains a separate Refund & Cancellation Policy, incorporated into these Terms by reference and made readily accessible before and after purchase. Unless otherwise required by applicable law, subscription payments are non-refundable, including payments for unused or partially used subscription time, change of mind, change in sport/team/coach/school, injury, loss of interest, or failure to achieve a desired result.
Cancellation prevents future renewal charges but does not automatically result in a refund or credit for the current paid period. Nothing in this policy limits any refund, cancellation, chargeback, or other consumer right that cannot legally be waived under applicable law.
Payments may be processed through third-party providers including PayPal, credit-card processors, payment gateways, or other authorized payment providers. You authorize the applicable payment provider to process payments according to your selected subscription.
You represent that you are authorized to use the payment method, that payment information is accurate, that you will maintain a valid payment method for recurring subscriptions, and that you will promptly update expired or invalid payment information. Third-party payment providers may maintain their own terms and privacy policies.
If a recurring payment fails, is declined, reversed, disputed, or otherwise becomes unsuccessful, ALYNED may retry the payment, request updated payment information, suspend access, terminate the subscription, or seek payment of outstanding amounts where legally permitted. Access may be suspended until the applicable payment obligation is resolved.
If you believe a charge was made incorrectly, you agree to first use the available ALYNED cancellation, billing-support, or refund procedures where applicable. Nothing in this provision restricts any legal right you may have to dispute an unauthorized transaction or exercise a non-waivable consumer protection. Knowingly initiating fraudulent or abusive payment disputes may result in account suspension or termination.
The NeuroAthlete Hub™ contains proprietary intellectual property belonging to or licensed to ALYNED Institute of Human Performance and/or CogMotion Performance, including without limitation the NeuroAthlete Hub™, NeuroAthlete System™, NeuroAthlete Progress Index™, CogMotion Performance™, CogMotion Neural Mastery™, the ALYNED Framework, ALYNED Institute, COGS Mission System™, the 7 COGS Performance Skills, NeuroAthlete archetypes, performance assessments and methodologies, training protocols and architectures, educational frameworks, exercises, models, diagrams, videos, audio, written materials, course structures, software, user interfaces, logos, brand identities, trademarks, service marks, copyrighted materials, trade secrets, and proprietary processes, terminology, assessment structures, scoring systems, and training methodologies.
These materials may be protected by copyright, trademark, trade-secret, intellectual-property, and other applicable laws.
Purchasing access to the NeuroAthlete Hub™ does not transfer ownership of any ALYNED or CogMotion intellectual property to the user. Your subscription provides a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for their intended purpose, for your personal performance-development purposes.
You may not use the Services or proprietary materials to create a competing product or training system, teach or distribute ALYNED materials commercially, resell access, reproduce or publish proprietary or course materials, share paid content outside authorized users, record and redistribute training, copy assessment instruments or scoring methodologies, reproduce proprietary frameworks, create derivative commercial works, remove proprietary notices, or claim ALYNED or CogMotion methodology as your own.
A personal athlete subscription does not automatically authorize a coach, trainer, consultant, psychologist, organization, school, academy, or other professional to use NeuroAthlete Hub™ content to train third parties commercially. Professional, team, academy, school, organizational, or commercial use may require a separate license or agreement.
Nothing in these Terms grants a user the right to represent themselves as an authorized ALYNED Institute or CogMotion Performance practitioner unless expressly authorized in writing.
You agree not to violate applicable law; harass or threaten other users; impersonate another person; share account credentials without authorization; circumvent subscription restrictions; attempt unauthorized access; scrape or extract proprietary information; reverse engineer the platform; introduce malicious code; interfere with platform security; circumvent technical protections; resell access; copy proprietary materials; misrepresent your relationship with ALYNED or CogMotion; or use the platform to create a competing service.
The NeuroAthlete Hub™ may permit users to enter reflections, journal entries, responses, comments, feedback, questions, or other materials. Users retain ownership of their User Content.
By submitting User Content, you grant ALYNED the limited rights reasonably necessary to store, process, display, transmit, and maintain that content in connection with providing the Services, subject to the Privacy Policy and applicable law. ALYNED will not publicly publish personally identifiable journal entries or private reflections as marketing content without appropriate authorization or another lawful basis.
The NeuroAthlete Hub™ may generate or collect performance-related information from assessments, training activities, skill development, progress tracking, reflections, self-reported information, platform interactions, and other activities within the Services.
These data may be used to provide personalized educational experiences, track progress, improve the Services, and develop aggregated or de-identified insights where permitted by applicable law. Assessment results are developmental tools and are not medical, psychological, intelligence, or clinical diagnoses. ALYNED may modify assessment models, benchmarks, scoring systems, algorithms, or methodologies as the NeuroAthlete System™ evolves.
Your use of the Services is also governed by the NeuroAthlete Hub™ Privacy Policy, which explains how ALYNED collects, uses, stores, protects, and discloses personal information and performance-related information. By using the Services, you acknowledge that you have reviewed the Privacy Policy.
Where required by applicable law, ALYNED will obtain appropriate parental or guardian consent before collecting or processing certain information from children or minors. The Parent/Guardian Consent and Minor Athlete Terms will explain applicable rights, permissions, information practices, and responsibilities. Parents and guardians may contact ALYNED regarding their minor athlete’s account or information through the designated contact process.
The NeuroAthlete Hub™ may utilize third-party technology providers, including payment processors, hosting providers, analytics services, email providers, authentication services, video platforms, artificial-intelligence services, communication platforms, data-storage providers, and other technology partners. Your use of third-party services may be subject to separate terms and privacy policies. ALYNED is not responsible for the independent practices, availability, security, or performance of third-party services except to the extent required by applicable law.
ALYNED seeks to provide reliable access to the NeuroAthlete Hub™ but does not guarantee uninterrupted or error-free operation. The Services may be temporarily unavailable because of maintenance, updates, technical issues, hosting problems, internet outages, cybersecurity incidents, third-party service interruptions, or events outside ALYNED’s reasonable control.
ALYNED may modify, improve, replace, suspend, or discontinue features, content, training modules, assessments, tools, or other portions of the Services, and may introduce new products, programs, features, membership levels, or pricing structures. Where required by law, reasonable notice will be provided regarding material changes affecting existing subscribers.
ALYNED may suspend or terminate access if a user violates these Terms, fails to satisfy payment obligations, misuses the Services, shares unauthorized access, infringes intellectual property, attempts to compromise platform security, engages in fraud, abuses other users, or uses the Services for unauthorized commercial purposes. Termination resulting from violation of these Terms does not automatically create a refund obligation.
Users may cancel their subscription at any time. Following cancellation, access generally continues through the end of the current paid subscription period unless the account is terminated for violation of these Terms, the Services are discontinued, applicable law requires otherwise, or another agreement provides different terms.
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” ALYNED disclaims warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or fitness to produce a particular performance result. ALYNED does not warrant that use of the NeuroAthlete Hub™ will produce any particular athletic, psychological, educational, professional, or financial outcome.
Athletic training and performance activities may involve inherent physical, psychological, and emotional risks. You are responsible for determining whether any activity, exercise, breathing practice, physical activity, or performance-training recommendation is appropriate for you. You should consult an appropriately qualified healthcare professional when appropriate before beginning physical activity or any practice that could reasonably affect your health or safety.
To the maximum extent permitted by law, ALYNED Institute of Human Performance, CogMotion Performance, and their owners, officers, employees, contractors, affiliates, licensors, partners, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the Services.
To the maximum extent permitted by law, ALYNED’s total aggregate liability arising from or related to the Services shall not exceed the greater of (1) the total amount paid by you to ALYNED for the Services during the twelve (12) months before the event giving rise to the claim, or (2) one hundred U.S. dollars ($100). Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ALYNED Institute of Human Performance, CogMotion Performance, and their owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from your violation of these Terms, your misuse of the Services, your violation of applicable law, your infringement of another person’s rights, your unauthorized use of ALYNED or CogMotion intellectual property, or your User Content.
Before initiating formal legal proceedings concerning a dispute, the parties agree to make a good-faith effort to resolve the dispute directly. If a dispute cannot be resolved informally, the parties may pursue applicable legal remedies and dispute-resolution procedures. Nothing in this provision prevents either party from seeking emergency injunctive or equitable relief where necessary to protect intellectual property, confidential information, platform security, or other legally protected interests.
These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law. Any venue or jurisdiction provisions remain subject to applicable consumer-protection laws.
ALYNED may modify these Terms from time to time. Material changes may be communicated through email, the NeuroAthlete Hub™, website notices, or other reasonable communication methods. The updated Terms will identify their effective date. To the extent permitted by law, continued use of the Services after the effective date constitutes acceptance of the updated Terms.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms, together with the NeuroAthlete Hub™ Privacy Policy, the NeuroAthlete Hub™ Refund & Cancellation Policy, the Parent/Guardian Consent and Minor Athlete Terms (where applicable), any applicable subscription or purchase terms, and any separate written agreement applicable to a team, academy, school, organization, or professional license, constitute the complete agreement concerning your use of the Services.
